Settlement Reached For Injured Painter Who Lost Both Hands After Electrocution

Firm Partner Benny Agosto, Jr. has reached a confidential settlement on behalf of Jose Gomez for the life-altering injuries Mr. Gomez sustained after he was electrocuted while painting an exterior portion of an apartment complex owned by Milestone Apartment Holdings, LLC. While in the process of painting the apartment complex, in order to fully paint the apartments, Mr. Gomez had to move and position a ladder. As he moved the ladder, it came into contact with a live electrical line adjacent to the building and as a result, Mr. Gomez sustained a severe electrical shock, causing him severe and disabling injuries, including the loss of one of his toes and both of his hands.

The Defendants in this case failed to properly construct the apartment complex with regards to electric utility lines and failed to take any action to move the utility lines, de-energize the utility lines, or otherwise make the working environment safe. These deficiencies in proper care were a direct violation of the Texas Health and Safety Code, the Texas Utilities Code, the National Electric Safety Code, the National Electric Code, and the regulations promulgated by various other governmental agencies. The Defendants in this case also failed to provide Mr. Gomez with the proper equipment needed to perform his job safely, such as rubberized ladders, as are required by numerous governmental regulations when working around power lines.

As the population in Texas has grown in recent years, the number of apartment complexes popping up all across the state has skyrocketed as well. Along with the construction of more apartment complexes comes many other expansions for infrastructure as well. It is vitally important that employers who are responsible for the safety of these construction workers follow the guidelines that have put in place in order to protect not only the lives and safety of their employees, but the general public as well.
