Confidential Settlement Reached in Dram Shop Case Against Tejano Bar, LLC D/B/A Coyotes Bar

Firm Partner Benny Agosto, Jr. reached a confidential settlement against Tejano Bar, LLC d/b/a Coyotes Bar regarding an incident that occurred on March 26, 2017. The settlement brings a favorable end to the lawsuit seeking compensation for the death of Ms. Christine Rocio in a car crash.

While at Coyotes Bar, Christine Rocio was sold or served alcoholic beverages for over six hours after it was apparent to Coyotes Bar and their employees that Christine was obviously intoxicated to the extent that she presented a clear danger to herself and others.

Just after the bar closed at 2:00 a.m., March 26, 2017, Christine was driving westbound on the 5600 block of West Baker Road in Baytown, Texas. Because she was still very intoxicated from having been over-served alcohol at Coyotes, Christine struck the curb, causing her vehicle to go off the roadway and then struck the culvert, resulting in her vehicle flipping on its left side and finally coming to a stop. Ms. Rocio was declared dead at 2:30 a.m. on March 26, 2017, as a result of the multiple blunt force injuries she sustained in the fatal crash.

The Texas Dram Shop Act and Texas’ other personal injury laws allow an injured person to file a lawsuit against the bar, club, or restaurant that caused the victim’s injuries, if the injuries are a result of their over-service of an obviously intoxicated patron. These laws allow victims to recover compensation for their physical, emotional, and economic injuries.

Through persistent efforts, the attorneys of the family were able to reach a confidential settlement alleging Coyotes Bar was negligent for serving alcoholic beverages after it was apparent to Coyotes Bar employees that she was obviously intoxicated to the extent that she presented a clear danger to herself and others.

Although the total amount is confidential, the settlement reached provides a just resolution for the family.
