L.A. Fitness Sued for Injuries Caused by Treadmill Malfunction

A lawsuit was filed in Harris County on October 11, 2018 against L.A. Fitness International LLC by a woman complaining of injuries she sustained after a treadmill malfunctioned and caused her to fall. The woman’s petition alleges that the fitness center failed to warn of the dangerous condition or failed to make the condition reasonably safe. She further alleges that the trip and fall caused her to sustain serious bodily injury. The woman is seeking to recover her reasonable medical care expenses, past, and future; past and future physical pain and suffering; past and future mental anguish; and her loss of earnings.

According to the woman’s petition, she was exercising at the fitness center and while on a stationary treadmill, violently fell from the machine after it malfunctioned. The woman alleges she was a regular member of the fitness center, was current on her monthly dues, and had regularly exercised on the treadmill machines on numerous occasions prior to her fall. She further alleges the malfunction was so sudden she had no chance to maintain her balance prior to the fall. The woman is seeking monetary relief in the amount of more than $100,000.

Businesses such as the fitness center in question, among others, have a duty to keep premises safe for patrons and to warn patrons of dangerous conditions-such as malfunctioning equipment.
