Doctors Sued for Overprescribing Painkillers

The families of Martin Maurer, Linda Paponetti, and Georgia Guzzi-Ozebek have filed suit against two family practice physicians at The Cleveland Clinic and alleged the doctors over-prescribed painkillers that led to accidental overdose and death.

Martin Maurer was a father and grandfather who worked as a long distance truck driver for over 35 years. Loading and unloading cargo, the constant shaking by the rig and previous motorcycle accidents caused chronic pain for which he sought treatment. According to medical records, Mr. Maurer was prescribed oxycodone (OxyContin and Percocet), Vicodin, and Xanax. In 2016, Mr. Maurer died after falling asleep in his living room chair. A toxicological exam determined one of the causes of death was acute intoxication from an accidental overdose of OxyContin.

Linda Paponetti died of an accidental overdose of oxycodone in 2016 as well. She suffered from chronic back pain, kidney failure, and an anxiety disorder. Georgia Guzzi-Ozebeck died the year prior from an accidental overdose of oxycodone, hydrocodone, and alprazolam. All three patients were treated by physicians at The Cleveland Clinic. All suits accuse the doctors of malpractice for failing to properly assess and treat their patients' pain and addiction and for failure to refer them to an addiction specialist, despite clear signs of substance abuse and addiction disorders.
