Lawsuit Filed Against Bar After Drunk Driver Killed Mother and Daughter

On January 14, 2017, a drunk driver caused a deadly five-vehicle crash after driving a Dodge Durango in the wrong direction on the Southwest Freeway in Houston, Texas.

Nearly a dozen people were taken to area hospitals for treatment following the crash, including a 34-year-old mother and her 3-year-old daughter. Unfortunately, the mother was taken to Memorial Hermann Hospital, where she was pronounced dead upon arrival. Her young daughter was also taken to Memorial Hermann Hospital where she died two days later due to the extensive injuries she suffered in the crash. The drunk driver, Victor Garcia, is currently serving an 18-year prison sentence for intoxication manslaughter.

Now, the surviving family of the mother and daughter are suing Merino's Sports Bar and Grill, claiming that Garcia was a patron there before the accident and was overserved. In the lawsuit, the family alleges the bar over-served alcohol to Garcia at a time when he was obviously intoxicated to the extent that he was a danger to himself and others. The lawsuit is seeking over $1 million in damages. Over-serving alcohol to patrons known to be intoxicated is a serious offense that can lead to devastating consequences.
