Confidential Settlement Reached for Family of Worker Killed at Construction Site

Firm attorneys Benny Agosto, Jr. and Jonathan Sneed have reached a confidential settlement against Piling, Inc. regarding a fatal incident that occurred on June 27, 2016. The settlement brings a favorable end to the family’s lawsuit seeking compensation for the gross negligence of the company that resulted in the death of their loved one.

On this day, the decedent was fatally injured after being struck by a the bucket of heavy machinery while working at a construction site located at the Dow Chemical facility in Lake Jackson, Texas. The decedent was employed by Piling, Inc. and was working with a crew to remove interlocking mats that had been previously used as a temporary roadway structure. To accomplish this, Piling provided a construction sequence that required the decedent to work in close proximity to heavy mobile equipment. At some point, the decedent was struck by the equipment and sustained severe injuries. Despite valiant efforts to treat his injuries, the decedent ultimately succumbed to his injuries two days later. He left behind a widow and two young children.

Through persistent efforts, the attorneys for the family were able to reach a confidential settlement alleging Piling was grossly negligent for failure to provide a safe worksite, failure to properly supervise, failure to properly train, and failure to provide safe equipment.
