Tracy Morgan Files Lawsuit Against Wal-Mart Over Deadly Bus Limo Crash

Tracy Morgan filed suit against Wal-Mart, the company who employs the truck driver who crashed into him, severely injuring Morgan. A passenger in the bus limo died as a result of the crash. In the criminal report, police said the truck driver had been awake for more than 24 hours at the time of the crash. He failed to notice traffic slowing in front of him and hit Morgan's bus despite trying to swerve out of the way, authorities said.

The truck driver was charged with vehicular homicide and assault by auto in the pileup that killed comedian James McNair and injured four others. Among the four injured, Tracy Morgan, a former cast member of "Saturday Night Live" and comedy series "30 Rock," remains in critical but stable condition.

The truck driver was operating a Wal-Mart truck. Wal-Mart said it believed that he was operating within federal guidelines, but said it would take full responsibility if the investigation shows its truck was to blame. Federal law mandates drivers work no more than 14 hours for any shift - 11 of those driving. The truck driver, has plead not guilty to the criminal charges of vehicular homicide and assault by auto.
