OSHA Citations Issued In Building Collapse Case

The Occupational Safety and Health Administration has concluded it's investigation into the building collapse that occurred on April 14, 2009 . At the time of the incident workers were performing demolition operations within a structure that collapsed on them and trapped and killed one worker. The Occupational Safety and Health Administration investigation concluded that the death of the worker was a "result of failure by his employer to conduct and engineering survey prior to demolition operations, failure to conduct inspections during the progression of work and failure to provide lateral bracing to wall sections."

Abraham, Watkins, Nichols, Sorrels, Agosto & Friend represents the widow, minor child and estate of the deceased worker in a wrongful death and survival cause of action.

After the initial collapse, a three week debris removal process was initiated to determine the cause of the collapse. Representatives of the firm were present throughout the three week period to monitor and conduct their own investigation into the cause of the collapse. The OSHA citation further concluded that the employer of the deceased worker should have complied with the American National Standard Institute [ANSI] Safety Standards for Construction and Demolition Operations. The case is currently set for trial in 2010 and discovery is ongoing.
