Great American Insurance takes the "Smoke and Mirrors" Award

The insurance industry never ceases to amaze me. Occasionally, the industry amazes me for something they have done to positively change the lives of individuals they touch. Unfortunately, the insurance industry usually amazes me by the greed they exhibit when dealing with their policy holders and the public at large. Recently, the Great American Insurance Company may have taken the prize -- literally -- for the extreme position they filed with the Houston Federal Court attempting to invoke an insurance policy exclusion to avoid paying a fire claim.

Lady Justice is Blind

Recently, I went down to the Harris County District Court and watched three of the lawyers at the firm finish trying a lawsuit. I was able to make it down to watch closing arguments. The case involved a worker who had been killed on the job after a terrible incident involving a large truck. Without going into the details of the incident, this was a wrongful death lawsuit. The evidence clearly showed that it could have been prevented if the defendant had simply followed its own rules. This particular worker was from another country and was working in the United States with the hopes of a better life for his family and himself. He had lost his life in pursuit of that dream.

End the Year Right...Volunteer!

The year is coming to an end and many folks are looking forward to 2009. With all the common stressors associated with the Holiday season, plus the nation's economic turmoil which continues to make us all somewhat uneasy, it is essential that we have a plan to get through the Holiday season stress-free.

"The Holidays: Not Always a Time for Joy"

With the Holiday Season in full swing and Christmas just around the corner, many people are gearing up to spend next week eating, drinking, opening gifts and creating new memories with their families and loved ones. Unfortunately, this isn't always the case. For many of our clients, the Holiday Season can be a time of serious depression and frustration. Many of our clients are unable to work because of the serious injuries caused by the reckless behavior of the defendants. Because of this inability to work, clients find themselves in difficult financial situations and unable to put presents under the tree for their kids. Even more difficult is when a client has lost a loved one because of someone else's negligence. It's during the Holiday Season that these clients find themselves desperately missing their spouse, their child, or their parent. For these individuals, the Holiday Season can be filled with memories of the tragic day their lives changed forever. To all of those clients struggling during this time of year, HANG IN THERE! Although we can never go back to the day before your world was turned upside down, remember we are here to guide you through these difficult times. Keep the faith and we look forward to an even better 2009!

The Growing Use of Internet Discovery

Internet discovery is becoming more prevalent in current litigation. It appears that average people post all kinds of personal and often incriminating information on the web. From MySpace to FaceBook you can often discover information useful in litigation. I have heard from a number of colleagues that internet discovery has come into play in their cases ranging from divorce, to personal injury and business litigation.

Health: Could You Have Diabetes and Not Know It?

The problem with a lot of lawyers, and non-lawyers alike is the fact that the busier they are, sometimes health issues are left unattended. Medical research shows that more than 5 million people in America don't know they have pre-diabetes or diabetes. One of the reasons diabetes goes undiagnosed in so many people is that adult onset diabetes (or type 2 diabetes) develops slowly. Many people will have this form of diabetes for as long as 10 years without noticing any symptoms of the disease. In the meantime, the disease can do irreparable damage to the body.
