Unveiling Of The Inaugural Hnba Journal Of Law & Policy

The Hispanic Bar Assoc, of Houston, the Mexican American Bar Assoc. of Houston and the Hispanic National Bar Assoc. joined efforts on October 23, 2008, in Houston, Texas, at the historic Abraham, Watkins, Nichols, Sorrels & Friend law firm, to honor and celebrate the unveiling of the HNBA Journal of Law & Policy inaugural edition. The evening's events brought together local attorneys and law students, as well as many Texas trial and appellate judges. All present were very impressed with the groups' efforts and enthusiasm and vowed to support the organizations in the future.

The Voters Have Spoken

Harris County saw a wave of incumbent judges ousted from their respective positions in this past election. Was this due to voter dissatisfaction with the local judges? Was this due to the unusually high voter turnout (1.18 million voters in Harris County)? Or, was this because President-Elect Obama carried the Democratic challengers into office? Regardless of the reasoning, the voters in Harris County have spoken. For better or worse, change is coming our way.

"It's Time to Give Thanks"

With Thanksgiving being tomorrow, I thought what better topic to write about than everything in this country we have to give thanks for. As the country appears to be going deeper into an economic depression, unemployment steadily increasing, and the holiday season just around the corner, many people are having a hard time finding something to be thankful about. For me, the first thing that comes to my mind is November 4, 2008. Why? DEMOCRACY! On November 4, 2008, the liberties and freedoms which this country stands for and was founded on stood up and showed the rest of the world that anything is possible in the United States of America. Whether you voted for Obama or McCain, it doesn't matter. The fact that you had a choice is what everyone in America should be thankful for. Just as precious as our right to vote in this country, it is our right to a trial by jury. Over the past few years, special interest groups more concerned about corporate profits than individual rights have done everything in their power to erode and eliminate American's right to a trial by jury. However, it's still here. As you gather around the dinner table on Thursday with friends and family, do not dwell on all of the negative news we hear but rather focus on the positives. Take a moment to recognize that we live in the greatest country in the world and each and every one of us has the right under the U.S. Constitution to participate in our government. Focus on the people around you and how lucky you are to have people who care for you and love you. Focus on the simple fact that there is food on your table and a roof over your head. Yes your portfolio may have taken a hit like the stock market, but guess what, you're still here to fight and live another day. One last thing, I want to take the time to thank each and every one of our clients for allowing us to help you and your families during such difficult times in your lives. For the attorneys at Abraham & Watkins, it's more than just a job. It's helping you and being thankful to have the opportunity to do it. Have a Happy Thanksgiving!

Hard Work Pays Off

Last week my Firm had the pleasure of winning a case for our clients. bagosto@abrahamwatkins.com, Jay Jackson and I presented our clients' case to a Harris County jury of 12 and the jury returned a verdict in favor of our clients.

Putting the Brakes on Unsafe Trucking Companies

There is a relatively new organization whose sole focus is on making the trucking industry safer for the highways across America. The Association of Interstate Trucking Lawyers of America (AITL America) was founded last year by a victim of a severe trucking accident whose goal is to help eliminate unsafe and illegal interstate trucking practices. Each member of the organization pledges to work aggressively within the law through learning, legislation and litigation to achieve their mission of dramatically reducing the number of traffic accidents, injuries and deaths across America that are caused by those trucking companies who have unsafe practices.

Victoria Bus Crash Cases Settle

On January 2, 2008 a bus operated by Houston based bus operators was involved in a rollover accident near Victoria, Texas. The bus rollover accident caused one wrongful death and numerous injuries. The law firm of Abraham, Watkins, Nichols, Sorrels & Friends represents nine claimants. The legal team for the plaintiffs group had to devise an innovative plan to obtain coverage under the insurance policy of Transportes Chavez, Inc. since the subject bus was not listed as a "covered auto" on its insurance policy and Transportes Chavez, Inc. contended that it did not operate the bus. On the date of the incident, the subject bus was not operating under the U.S. D.O.T. number of Transportes Chavez, Inc. However, plaintiff's legal team alleged that two of its employees were controlling the operation of the subject bus.

Supreme Court Ruling Favors Bars

The Texas Supreme Court issued a ruling on March 28, 2008 which helps bars avoid liability. In the case of 20801, Inc. v. Parker, 249 S.W.3d 392 (Tex. 2008), the Supreme Court reduced the elements a bar must prove when an injury is caused by a person to whom it serves too many drinks.
