The lawsuit alleges that Mr. Cuevas suffered severe brain damage when the scaffold he was working on collapsed at a construction site located at 2925 Richmond Avenue, Houston, Texas 77098. The construction site is controlled by Burton Construction Company, the general contractor for the site.

According to the preliminary reports, the scaffold Mr. Cuevas was working on collapsed and his safety line was severed in the process, causing him to fall to the ground from over seven stories. Following the fall, Mr. Cuevas was taken to Ben Taub Hospital and treated for severe brain damage. He is currently in a vegetative state due to the injuries he sustained from the fall.
